STANDARD TERMS & CONDITIONS OF SALE
DATE EFFECTIVE
As of the above date, these terms and conditions of sale supersede all previous terms and conditions.
ORDERS
Orders may be placed by post, telephone, fax, email, or other agreed electronic means.
The Company does not normally acknowledge orders but aims to deliver items in stock within two working days of receipt of order, and non-stock items as soon as possible. However, the Company does not accept any liability arising from delay in delivery, or from incorrect ordering by the customer.
PRICING
Prices charged are those current at the time of sale and are normally quoted excluding VAT.
VAT will be charged additionally at the rate in force at the time of sale. Price increases cannot be deferred except by special agreement.
PAYMENT
Newhall Janitorial Ltd reserve the right to charge interest on overdue payments for all customer types, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998. Goods will remain the property of Newhall Janitorial Ltd until paid for in full. Where credit facilities have been allowed settlement is due by the end of the month following the date of delivery, or as otherwise stated on the
invoice.
CREDIT FACILITIES
Credit accounts are subject to receipt and approval of credit application form. Newhall Janitorial Ltd reserve the right to grant, refuse or discontinue any credit facilities with immediate effect at any time. Credit limit will be as agreed by Newhall Janitorial Ltd Accounts
Department. Credit is subject to receipt of official order. Pre-payment or Cash On Delivery will be required where credit account is not approved.
DELIVERY PROBLEMS
Any delivery discrepancies or damages should be notified on the delivery note, a copy of which is retained by our delivery drivers.
Customers are requested to both sign and print names to acknowledge delivery. Any subsequent findings should be notified in writing to the Company within THREE working days of delivery. When delivery is made by carrier, the customer must also notify the carrier in accordance with the carrier’s terms and conditions.
RETURNS
The Company will by arrangement accept return of unwanted stock, provided it is in its original packaging, in a suitable condition for resale and within 30 days of delivery. Any credit given is solely at the discretion of the Company. A restocking fee of 20% will be applied at the discretion of Newhall Janitorial Ltd.
SUITABILITY
The Company makes no guarantee that goods supplied are suitable for any specific purpose. The customer must satisfy itself that the goods are suitable for the intended use.
FORCE MAJEURE
Newhall Janitorial Ltd shall not be liable in any respect whatsoever in any delay in the performance of, or the failure to perform, any obligation pursuant to any order or contract as a result of circumstances beyond its control.
LIABILITY
In the event of a dispute arising from the sale of goods the liability of the Company shall be limited to the price of the goods. The Company will not accept any claim unless it is notified within 3 months of the date of sale.
TITLE OF GOODS
The property of the goods shall not pass to the customer until such time as payment in full has been received by the Company, but the risk attaching shall pass to the Customer at the time of delivery.
ERRORS & OMISSIONS
Typographical or clerical errors or omissions in any document are subject to revision without penalty or prejudice.
APPLICABLE LAW
Any contract for the sale of goods by the Company shall be governed & construed in accordance with the law of England and Wales.
